What A First DUI Puts In Motion
Four Things Start Moving After the Arrest
A driver charged with DUI can face several license actions at once, on top of the court case. Here is what Mississippi's statute and Department of Public Safety list for a first offense.
- A 30-Day Permit The receipt for your license works as a temporary permit for 30 days. To stop a 90-day suspension, contact the court, request a trial date and ask to extend the permit.
- The Charge A first conviction carries a fine of $250 to $1,000, up to 48 hours in jail, or both. A qualifying first offense may be non-adjudicated.
- A Required Class Conviction or non-adjudication means completing the Mississippi Alcohol Safety Education Program. The class fee is $225.
- A 120-Day Suspension After a first conviction a regular license is suspended for 120 days unless the court orders an ignition-interlock restricted license.

FAQ
Frequently Asked Questions
Still have questions? Call for a free consultation.
What happens to my license after a first DUI arrest in Mississippi?
The officer should take your license and give you a receipt. That receipt works as a temporary permit for 30 days. If no one contacts the court in that time to get an order extending it, your driving privileges are suspended for 90 days.
What is the penalty for a first DUI in Mississippi?
A first conviction carries a fine of $250 to $1,000, up to 48 hours in jail, or both. The court must also order the Mississippi Alcohol Safety Education Program. A regular license is suspended for 120 days unless the court orders an ignition-interlock restricted license.
What is non-adjudication?
The court withholds a finding of guilt and sentencing and places you in a program with conditions. You can use it one time. Holders of a commercial license or learning permit at the time of the offense are not eligible.
Is the first consultation free?
Yes. The consultation is free, by appointment only. Call 662-494-4999.
